TERMS OF SERVICE

General terms

​

  •  these quotes are only for personal use 
    Please note that, if the artwork is going to be exploited,
    fees can go up to +150% - 350% of the base price    :

    FOR PERSONNAL USE :  Base price is applied.
    client is free to use for non-commercial purposes,
    ( Print the artwork for themselves, show it online (credit is required when possible) and display it as they please. The sale of any type of material featuring or derived from said commission is not allowed. If the client wants to use the piece commercially after the commission is done, it can be discussed and a fee will be applied.

    FOR COMMERCIAL USE :  +150% fee on top of the base rate.
    for any commercial advantage or monetary compensation. Using images on or in anything that is created with the intention of making a profit
    would be considered commercial use.
    I, the artist, maintain ownership of said artwork for my own personal and commercial use and to display it on my portfolio and social media.

    EXCLUSIVE RIGHTS : +350% fee on top of the base rate.
    are commissions that give the client complete ownership of the artwork. Exclusivity transfers ownership of not just the actual piece of artwork, but and all associated rights (the intellectual property) to the client as well. The use and display of said piece is allowed only to the client.
     

  • Prices provided on the price list are not set, they serve as an orientation,
    and are subject to change based on demand.
     

  • I have the right to accept or refuse any order for any reason

What I need to know :

  1. Name / desired pronouns
     

  2. Commission type ( bust / half body… etc )
    As well as the add ons or desired background
     

  3. Brief description , references if any …
     

  4. The orientation ( portrait landscape square crops etc )


( Note that I will do my best to follow the overall character design , but not attempt to

match it 100% in various cases.  My artistic interpretation will take precedence )

Process and delivery

​

  1. After I have accepted your commission, the process will be shared with you regularly in order to provide any feedback and corrections you might have. You have to approve those so I can continue the work.
     

  2. Delivering Times can vary , between 2 weeks and 3 months depending on factor such as complexity of your request, health…
    Each piece is unique and personalized in its own way ;
    some can take just a few weeks while others can take longer.
     

  3. Once the piece is finished , you will receive the full resolution image. Note that there isn’t any phyisical product.
    If you need a particular file format or size don’t forget to mention it before I start working on your commission.

Revisions
 

  1. Up to 3 revisions before the final drawing are included in the price for your commission.
     

  2. If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it.
     

  3. A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made -

Payment
 

  1. Currency accepted is either USD or Euro and can be paid through PayPal or any French payment service.
     

  2. Commissions can be paid either 100% upfront
    or split 50% upfront and 50% after sketch approval,
    this excludes sketch commissions.
     

  3. Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.

Copyright & usage

I, Stella Colorado / Petit Kitsune (referred as the artist):
​

  1. Have the right to cancel and refund the order at any time for any reason.
     

  2. Retain all copyrights over the commissioned artwork, unless they haven’t been purshased.
     

  3. I reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books.
     

  4. I will NOT claim the intellectual property (IP) of the commissioned artwork.
     

  5. I will NOT profit further from the commissioned artwork unless you
    (the customer) break any of the terms.
     

You (the customer/commissioner) :

​

  1. You may upload the commissioned artwork on any website and social channels - as an icon for a personal website/blog or wallpaper as long as it is not monetized.
     

  2. You may NOT make profits from the commissioned piece unless you have paid for the rights. (reselling, redistributing, uploading to POD-services, make prints, etc.)
     

  3. You may NOT alter the commissioned artwork without my (the artist's) consent. This also includes Sketch Commissions - you may NOT work further on the commissioned artwork.
     

  4. You retain the rights to the intellectual property (IP).
     

  5. You may NOT use the commissioned artwork for commercial purposes unless you have paid the rights for.
     

The following is considered copyright infringement :

​

  1. Reproducing/using the copyrighted artwork commercially - means making money off it in any way, unless we discussed it beforehand.
     

  2. Claiming the artwork as your own
     

  3. Altering the artwork without my consent
     

  4. In some cases, the commercial rights to the image may be purchased.

Refund policy
​

Only the following cases can get a refund:

 

  1. If you cancel your order before I have started working on it.
     

  2. If for any reason I cannot proceed with your order
     

  3. If a mistake was made on my part
     

No refund will be made :

​

  1. if I have already started working on your order.
     

  2. If you request a Paypal chargeback at any point when you were
    not allowed to ask for a refund you will lose all before mentioned rights to the commissioned piece and I will have the full right to profit further from it in any way.
     

  3. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted
    for commissioning me again.
